DEED OF CREATION OF NEW REAL BURDENS AND CONDITIONS

THE TITLEHOLDERS’ ASSOCIATION at THE PARK ECOVILLAGE, FINDHORN

This is a generic version of the Deed of New Real Burdens and Conditions and is provided to prospective purchasers of property at The Park, Findhorn for information only.

This document was approved by the Title Holders Association on 31st August 2011.
It creates the legal structure through which Titleholders at The Park Ecovillage agree that the Deed of Community Conditions will remain as part of their deeds in perpetuity.

I / WE [INSERT FULL NAME AND DESIGNATION OF THE ACTUAL TITLE OWNER], heritable proprietor of ALL and WHOLE [INSERT PROPER CONVEYANCING DESCRIPTION BY REFERENCE TO TITLE WHETHER RECORDED OR REGISTERED] (“the Said Subjects”) CONSIDERING that the Park Ecovillage as shown outlined [  ] on the plan annexed and signed as relative hereto has been formed and it is our desire that the Said Subjects belonging to me / us be incorporated in and form part of that Ecovillage and that henceforth the Said Subjects be deemed to be entitled to the whole rights and obligations and subject to the whole real burdens and others contained in the Deed of Community Conditions aftermentioned and that the Titleholders’ Association of the Park Ecovillage by acceptance hereof, as is signified by the signature of their Designated Agent, hereby consent to the incorporation of the Said Subjects into the Park Ecovillage (all as the “Titleholders’ Association”, “Designated Agent” and “Park Ecovillage” shall have the same meaning herein as ascribed to them respectively in the Deed of Community Conditions aftermentioned; Therefore I / we hereby impose on the Said Subjects the whole terms and conditions, real burdens and others as set out in the Deed of Community Conditions by James Michael Shaw and Others, as Trustees thereinmentioned on behalf of The Findhorn Foundation dated the Sixteenth day of September and recorded in the Division of the General Register of Sasines for the County of Moray on the Seventeenth day of November, both months in the year Two thousand and four, a copy of which Deed of Community Conditions is annexed and signed as relative hereto and the terms and conditions therein are deemed to be incorporated herein as if typed out at length; And I / we and the Titleholders’ Association hereby agree that henceforth the conditions and real burdens under which the Said Subjects shall be governed are as set out in the said Deed of Community Conditions and the burdens and conditions contained in the said [  ] [refer to original title deed] will be deemed to be of no effect as between me / us and my / our successors as proprietors of the Said Subjects and the Titleholders’ Association: IN WITNESS WHEREOF
